SAFARI BOOKING TERMS

Welcome to Amelia Safaris. We encourage all Users to read and understand these terms (“Safari Booking Terms”) prior to making use of the Services. Please note that the following clauses form part of the Terms available on our Website and shall be read in conjunction with the same.

  1. BOOKING REQUEST AND CONFIRMATION
  1. By submitting a booking request via any of our Booking Channels, you acknowledge that you have read, understood, and agree to be legally bound by these Terms.
  1. A binding booking (“Booking”) shall be deemed to have been made only upon issuance of a written confirmation by Ameliya Safaris of the booking to you.
  1. Booking amendments must be requested in writing, are subject to availability and additional fees, and may be treated as cancellations if requested within 90 days of travel at Ameliya Safaris’ discretion.
  1. Ameliya Safaris expressly reserves the right, at its sole and absolute discretion, to decline or refuse any booking request without obligation to provide reasons.
  • USER OBLIGATIONS AND REPSONSIBILITIES  
  • Travel and medical insurance are mandatory and must be obtained prior to the commencement of the trip with proof provided before travel. Failure to provide proof may result in booking cancellation and applicable fees.
  • The Services are provided to you by Ameliya Safaris for your personal and non-commercial use only. Consequently, the Users are prohibited from using the Services for commercial purposes or for any other purpose not contemplated under these Terms.
  • You acknowledge and accept that if you provide any information that is untrue, inaccurate, not current or incomplete as part of the User information, and/or we have reasonable grounds to suspect that any User information provided by you is untrue, inaccurate, not current or incomplete, or not in accordance with these Terms, we have the right, at our sole discretion, to: (i) request you to promptly update or correct such User Information; and/or (ii) immediately and indefinitely suspend your Account, block your access to the Platform, terminate and/or delete your Booking and/or refuse provide any current or future Services to you.
  • PHOTOGRAPHY AND CONTENT USE
  • Ameliya Safaris reserves the irrevocable, worldwide, royalty-free right to use, reproduce, publish, and distribute any photographs, video recordings, or other visual or audio content captured by us, our employees, agents, or contractors during the course of your safari for promotional, marketing, advertising, or related business purposes. Such use may occur in any format or media, whether currently known or developed in the future, without further notice or compensation to you. If you do not wish to be featured in such materials, you must notify Ameliya Safaris in writing prior to the commencement of your safari. In the absence of such written notice, your participation shall be deemed as consent to such use.
  • If the User intends to undertake any filming, photography, or audio recording for commercial sale, licensing, or other profit-making purposes during the safari experience with Ameliya Safaris, the User must obtain prior written consent from us. Use of such content for personal sharing, social media (including YouTube channels), blogs, or entry into photography/videography competitions is permitted, provided it does not misrepresent or harm Ameliya Safaris’ reputation. Any unauthorized commercial exploitation, reproduction, distribution, or publication of images, videos, or recordings beyond the scope permitted herein shall be deemed a material breach of these Terms and may result in legal action, including injunctive relief, claims for damages, and recovery of legal fees incurred by Ameliya Safaris.
  • PROVISIONAL BOOKINGS
  • Ameliya Safaris may offer Users the option to make a temporary reservation (“Provisional Booking”), the terms of which may vary depending on factors such as the destination, lodge, hotel, or country for which the booking is requested.
  • A Provisional Booking is subject to written confirmation and payment of the applicable deposit within the validity period notified by the Company. If the User does not provide such confirmation and payment within the notified period, the Provisional Booking will automatically lapse without any obligation on the Company.
  • Any request for extension may be considered at the Company’s sole discretion and, if granted, will be treated as a fresh booking subject to the terms and conditions prevailing at the time of extension.
  • DEPOSIT AND PAYMENT
  • Unless otherwise agreed in writing with Ameliya Safaris, all payments shall be made in the currency quoted on the invoice, and deposits and/or payments in any other currency will be accepted only by prior confirmation by the Company. Failure to comply may result in delays or rejection of payment, with the User bearing any additional costs or fees arising from currency conversion or non-compliance.
  • At the time of booking, the User shall pay a non-refundable deposit equal to 50% of the total booking amount. Of the total booking amount, 25% shall be due 120 days prior to the trip start date, and a further 25% shall be due 90 days prior to the trip start date. The initial 50% deposit becomes non-refundable once paid. The balance amount shall be refundable as follows:
  • Cancellation at least 120 days prior to the trip start date – 100% of the balance amount refunded.
    • Cancellation between 90 and 120 days prior to the trip start date – 35% of the total booking amount refunded.
    • Cancellation within 90 days of the trip start date – no refund.
  • Amendment in dates within 90 days from arrival is treated as a cancellation. Please note that the date of written communication (e‑mail) of intent to cancel will be the date considered for the calculation of the cancellation fees. The cancellation amount is calculated as per the total booking amount and not as per the advance deposited. No refunds in case of refusal to use a service or activities.  
  • The outstanding balance of the invoice shall be paid in full and received in Ameliya Safaris’ designated bank account no later than [·] days prior to the scheduled date of arrival, in accordance with the payment terms set forth herein.
  • For bookings made within [·] days of the scheduled date of arrival, the entire invoice amount shall be payable in full within [·] days from the date of booking.
  • In the event that the final payment is not received by us within the stipulated timeframe, we reserve the right, at our sole discretion, to cancel the booking and release any reserved accommodations and/or services without any further obligation or liability to you. Under such circumstances, the deposit shall be forfeited and retained by us as liquidated damages.
  • Ameliya Safaris will honour agreed rates under normal circumstances, for which the preferred mode of payment would be bank wires or UPI transfers, wherein all card transfers will incur a 3.5% percent service fee, but reserves the right to adjust rates and terms at any time due to factors beyond its control, including but not limited to changes in fuel costs, exchange rates, concession or camping fees, service levies, taxes, or material regulatory changes impacting operational viability, even for confirmed and fully paid bookings. Any change in third-party charges, such as accommodation or flight costs, after a Booking are the User’s responsibility, and by confirming a booking, you accept these Terms and agrees to pay any such additional invoiced charges.
  • Additionally, any changes in the tax levied by the government or park/conservancy fees shall be borne by the User.
  • THIRD PARTY SERVICES
  • In instances where third-party service providers impose requirements for additional deposits, full upfront payment, or earlier balance payments prior to arrival, while Ameliya Safaris will endeavour to notify the User of such requirements, the User shall remain liable to make such payments when due, and such amounts will be reflected in the invoice or otherwise communicated by the Company.
  • Please note that cancellations involving bookings which include third-party services or properties may be subject to additional or alternative cancellation fees and penalties as stipulated by the respective third-party providers’ terms and conditions. These third-party cancellation policies shall apply in conjunction with, or in place of, Ameliya Safaris’ cancellation terms where applicable.
  • By confirming a booking that includes third-party services, you acknowledge and agree to be bound by these third-party payment and cancellation requirements.
  • FORCE MAJEURE
  • Any circumstance beyond reasonable control, including but not limited to acts of God, natural disasters, epidemics or pandemics causing travel restrictions, terrorism, civil unrest, war, sanctions, embargoes, diplomatic severance, nuclear, chemical, or biological incidents (“Force Majeure Event”). Except as expressly stated, Ameliya Safaris shall not be liable for failure or delay in performance, nor obligated to refund or compensate, if caused by a Force Majeure Event, provided reasonable steps to fulfil obligations have been taken. No liability for resulting loss, damage, or inconvenience.
  • Subject to Cancellation Terms and Force Majeure Events, Ameliya Safaris may cancel or modify tours, itineraries, accommodations, pricing, or bookings due to Force Majeure and may offer rescheduling at its discretion.
  • DISCLAIMER AND LIMITATION OF LIABILITY
  • To the maximum extent permitted under applicable law, you, on behalf of yourself and any minors or dependents accompanying you, voluntarily, irrevocably, and unconditionally waive, release, and discharge Ameliya Safaris from any and all claims, liabilities, damages, or losses (whether known or unknown) arising out of or in connection with any injury, illness, death, or loss sustained during participation in any Service arranged or provided by Ameliya Safaris, including incidents resulting from acts of nature or other events beyond our reasonable control.
  • Ameliya Safaris reserves the right, at its sole discretion and without any liability or obligation to compensate, refund, or rebook, to cancel, reschedule, or terminate any safari or booking. This may occur under circumstances including but not limited to User illness, unlawful or disruptive conduct, safety concerns, force majeure events, or any behaviour deemed incompatible with the nature and spirit of the Service.
  • By confirming your Booking, you agree to be personally responsible for full payment and compliance with these Terms on behalf of all individuals included in the Booking, including minors and dependents.
  • Nothing in these Terms shall exclude or limit Ameliya Safaris’ liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, or for any other matter for which exclusion or limitation of liability is not permitted under applicable law.
  • By availing the Services, you acknowledge and agree that, while Ameliya Safaris endeavours to provide a reliable, seamless, and safe safari experience, the Services are inherently subject to numerous variables, including but not limited to the availability of specific amenities, wildlife sightings, itineraries, and travel arrangements. Such factors may be affected by environmental conditions, logistical constraints, or other circumstances beyond the reasonable control of Ameliya Safaris. Ameliya Safaris does not warrant or guarantee that the Services will be uninterrupted, error-free, or that any particular experience, or sighting will be achieved, and you waive any claims to the contrary to the fullest extent permitted by applicable law.
  • ASSUMPTION OF RISK
  • You acknowledge and accept that participation in any safari or related travel Services involves inherent and unpredictable risks, including but not limited to those arising from encounters with wildlife, variable weather conditions, remote or rugged terrain, transportation, outdoor activities, and the actions or omissions of other participants or third-party service providers.
  • You further acknowledge that such risks may result in injury, illness, or death, and may occur despite reasonable precautions taken by Ameliya Safaris. By proceeding with any Booking, you voluntarily assume all such risks, whether foreseen or unforeseen, and agree that Ameliya Safaris shall not be liable for any loss, harm, or injury arising therefrom, except where prohibited by applicable law.
  1. INDEMNIFICATION
  1. To the fullest extent permitted by law, you agree to indemnify, defend and hold harmless Ameliya Safaris, its affiliates, officers, directors, employees, agents, licensors, suppliers, and service providers from and against any and all claims, demands, actions, proceedings, losses, liabilities, damages, costs, and expenses (including legal fees) arising out of or in connection with: (a) your participation in any activity or travel arranged or facilitated by Ameliya Safaris; (b) your breach of the Terms and the Safari Booking Terms; (c) your acts, omissions, or negligence; or (d) any claim brought by a third party as a result of your conduct.
